In den meisten Fällen hat man es sich ja nicht ausgesucht. Eine krankheitsbedingte Auszeit vom Job. Manchmal ist es ja nur ein kleines Aus. Eben die klassische jahreszeitliche Infektklaviatur mit Fieber, Husten und Schnupfen. Aber manchmal packt das Leben noch eine große Schippe oben drauf und es dauert länger. Für Beschäftigte die innerhalb eines Jahres länger als sechs Wochen ununterbrochen oder wiederholt arbeitsunfähig sind, sind Arbeitgeber verpflichtet ein sogenanntes „freiwilliges“ Betriebliches Eingliederungsmanagement (BEM) anzubieten. Entscheidet sich der Arbeitnehmer dafür, ist zu beachten, dass die Gesundheitsdaten, aus dem BEM-Verfahren nicht in die Personalakte des Beschäftigten übernommen werden dürfen, da sie als besonders sensible personenbezogene Daten unter hohe Anforderungen gestellt werden. Nur so kann gewährleistet werden, dass diese vor unrechtmäßigen Zugriff geschützt sind……..Was genau zu beachten ist……..
